RIGHT WITHDRAWAL FORM
PRE-CONTRACTUAL INFORMATION
Pursuant to art. 49 of Legislative Decree. 6 September 2005, n. 206 - Consumer Code
The pre-contractual information below is an integral part of the "online sales contract" of products that the Supplier undertakes to conclude in the context of a remote sales system from the same, organized through its website ( https: // fiorottowine.it) ; they cannot be modified except following a further express agreement with the Customer.

1) Identification of the Supplier

2) Main features of the products
The products are indicated, even in their essential characteristics, directly on the Supplier's website at the page: https://fiorottowine.it
For each product viewed, the Customer will have the opportunity to access a specific sheet containing the main information and data relating to the product itself (including for example: type of vine, denomination, area of origin of the grapes, alcohol content) as well as any minimum quantities that may be purchased by the customer.

3) Condition for sale
Since these are products for which the sale is permitted by law only to buyers over the age of 18, it is specified that the purchase procedure will be finalized only to Customers who have this age requirement.

4) Total price of the products
All sales prices of the products contained in the Supplier's online catalog are expressed in euros and include VAT and any other taxes.
The cost of shipping and any additional charges, if any, are not included in the purchase price, but are indicated and calculated separately. By completing the purchase order, and in any case before the purchase procedure is completed, the Customer will be able to verify these costs and charges.
5) Methods of payment
The payment of the price can only be made by credit card.
The Supplier guarantees that all communications relating to payments take place on a special line protected by an encryption system; it also guarantees the storage of information connected to the payment with an additional level of security encryption and in compliance with the provisions of the current legislation on the protection of personal data.
Since the conclusion of the purchase procedure implies the onset of the Customer's obligation to pay the price of the selected products, it is specified that when the order is sent - which as indicated in the following point 10) means the conclusion of the contract with the Supplier - follows the obligation to pay. In any case, the Supplier assumes no responsibility for any fraudulent or illegal use that may be made by third parties (for example, credit cards) upon payment of the purchased products, if he proves that he has adopted all the possible precautions based on the best science and experience of the moment and based on ordinary diligence.

6) Methods and times of delivery
The delivery of the products will take place, from the date of completion of the purchase, in 24/48 hours for Italy, and from 3 to 5 working days for Europe. The above delivery times must in any case be considered indicative, as they may also be longer due to the actual place of destination of the products (eg deliveries to islands).
The Customer will be able to check the delivery status of the products by receiving a specific email showing all the data flow concerning the shipment.
Deliveries are made from Monday to Friday - however never on holidays - during normal office hours; for this reason the Customer is suggested to indicate an address where the delivery of the products can still be guaranteed.
Finally, it is specified that upon delivery, the Customer is required to ascertain the state of the packaging containing the Products purchased and to report to the Supplier's representative, also giving appropriate evidence in the relative delivery documents (also through acceptance subject to the Products), any damage that could be found through a simple visual check of the packaging itself.

7) Right of withdrawal
The Customer will have the right to withdraw from the purchase commitments, without any penalty and without the obligation to specify the reason, within 14 (fourteen) days from the date on which he acquires physical possession of the products purchased online.
To exercise the right of withdrawal, the Customer is required to inform the Supplier of his decision to withdraw from this contract by means of an explicit declaration, using the "Withdrawal Form" shown at the end of these contractual conditions.
The Customer can complete and send the withdrawal form or any other explicit declaration by sending it to the email address info@fiorottowine.it
In any case, without delay, the Supplier will confirm receipt of the Customer's notice of withdrawal, by sending this specific e-mail.
To meet the withdrawal deadline, it is sufficient for the Customer to send the communication concerning the exercise of the right of withdrawal before the expiry of the withdrawal period indicated above.
To withdraw from the Subscriptions, simply enter the reserved area, select "my subscriptions" in the menu and click "withdraw from the subscription" corresponding to the subscription you wish to cancel. Withdrawal from the subscription is only allowed after third renewal cycle.

8) Effects of withdrawal (methods of refund and return of products)
If the Customer withdraws from this contract, he will be refunded the purchase price of the returned products without undue delay and in any case no later than 14 (fourteen) days from the day on which the Supplier is informed of the Customer's decision to withdraw from the contract.
This payment will be made using the same payment method used by the Customer for the initial transaction, unless the Customer has expressly agreed otherwise with the Supplier in any case, the Customer will not have to incur any costs as a consequence of this reimbursement.
The refund may be suspended until the products to be returned are received. In any case, to be entitled to a refund of the price paid, the products must be returned intact and in their original packaging, therefore the Customer should not have opened the packaging of the product purchased online; in the latter circumstance, the right of withdrawal must be considered excluded, as provided in this regard by Article 59, lett. e) of the Legislative Decree 6 September 2005, n. 206 - Consumer Code, thus making it impossible for the Customer to withdraw from the contractual commitments concerning the online purchase or to request the refund of the sum paid for the purchase itself.
The Customer is required to return the products to the Supplier (Società Agricola Vittoria SS di Fiorotto Daniele & C. - Via Priula, 85 - 31040 Nervesa della Battaglia (TV), info@fiorottowine.it) without undue delay and in any case within 14 (fourteen) days from the day on which he communicated his withdrawal from this contract. The deadline is met if the products are returned before the expiry of the period of 14 (fourteen) days. The return of the products must be made by postal service or courier. The direct costs of returning the products will be borne by the customer alone.

9) Warranty
The Supplier guarantees the compliance of the products with the current sector regulations. The products must be stored by the Customer according to the instructions provided by the Supplier and in any case in environments whose hygienic-environmental conditions are suitable for the products themselves; consequently, the Supplier will not be liable for disputes concerning products that have not been stored by the Customer in accordance with the foregoing.
Any non-conformity of the products may be reported by the Customer according to the current regulations for consumer protection, and in particular pursuant to Legislative Decree 206 of 6 September 2005 (so-called Consumer Code). The complaint of non-conformity of the products must be sent to the Supplier as specified in the following point 13). In case of non-compliance, it is the Supplier's responsibility to provide for the free replacement of the non-compliant product within a reasonable time.

10) Conclusion of the contract and storage methods
The contract for the online purchase of products between the Supplier and the Customer will be concluded through the internet, by accessing the Customer to the Supplier's website and following the purchase procedures indicated therein.
The contract is concluded through the exact compilation and the consent to the purchase expressed through the adhesion sent online. Before concluding the purchase, the Customer will have the opportunity to check the contents of the purchase order and, if necessary, to correct and / or modify the data entered; it will therefore be its specific obligation to verify the correctness of the data in question.
When the Supplier receives the order from the Customer, it sends a printable e-mail without delay, which contains the details of the orderer and the order, the price of the product purchased, the shipping costs and any additional accessory charges, the address where the product will be delivered, the delivery times and the existence of the right of withdrawal. The Customer undertakes to print and keep the purchase order.
Pursuant to art. 12 of Legislative Decree. n.70 / 2003, the Supplier informs the Customer that each order sent is stored in digital form on the server at the manager who hosts the site and in paper or digital form at the Supplier itself, in any case according to confidentiality and security criteria. .
The registered Customer still has the possibility to consult the forwarded order at any time by accessing the appropriate area of the Supplier's website, entering their Login and Password (as issued at the time of the preliminary registration of their personal data).

11) Availability of products
The Supplier ensures, through the electronic system used, the processing and fulfillment of orders. For this purpose, it indicates in real time, in its electronic catalog, the products available and those not available.
If an order exceeds the quantity existing in the warehouse, the Supplier, by e-mail, will inform the Customer if the product is no longer bookable or what are the waiting times to obtain the chosen product, asking if he intends to confirm the order. or less.

12) Applicable law
These conditions of sale are governed by Italian law.

13) Communications and complaints
Written communications directed to the Supplier and any complaints will be considered valid only if sent by e-mail to the e-mail address info@fiorottowine.it
